Kimberlie Dawson, the mother of a Lubbock woman who was killed in a car crash, has filed a lawsuit against the other person involved in the crash, Gabriel Zerrata, and Skooners Grill & Bar, where the suspect claims they were drinking before the crash.

The crash happened in the early morning hours of Saturday, January 16th, 2021. KAMC News reports that Zerrata crashed his vehicle into one driven by 19-year-old Jessica Helmers at the intersection of University Avenue and the Marsha Sharp Freeway.

Zerrata is said to have been going more than 40 mph over the speed limit right before the crash. Helmers reportedly had a green light to go through the intersection, and Zerrata the red light.

Helmers died in the crash, and Zerrata was arrested for manslaughter.

Zerrata told officers that before the crash happened, he was at Skooners to have drinks and shots. The Texas Alcoholic Beverage Commission (TABC) has since opened an investigation that was still pending as of Thursday, January 28th.

The lawsuit claims that Skooners overserved Zerrata alcohol, claiming that "Skooners' actions and/or inactions were a proximate cause of Zerrata's intoxication." Both Zerrata and Skooners have been blamed for the death of Helmers.

Skooners has yet to file their side of the story in court records, according to KAMC News.
