In the past if you wanted to tick off Texans, all you had to do was mention California. Now, the proliferation of data centers in the state has Texans livid and the Governor is now addressing the issue.

Texas Orders Mandatory Audit of Data Centers Before Grid Interconnection

Governor Abbott has instructed state utility regulators to freeze new grid connections for data center developments until in depth operational audits are conducted. In a directive issued to the Public Utility Commission of Texas (PUCT) and the Electric Reliability Council of Texas (ERCOT), Abbott specified that every pending facility must undergo rigorous verification before receiving authorization to connect to the state power grid.

Long Time Coming

The executive order stems from months of frustration over non-compliance with state-mandated surveys designed to track energy and water consumption under the General Appropriations Act. Under the new mandate, any facility failing to meet PUCT, ERCOT, or statutory guidelines will be flatly refused grid access.

Strict Disclosure Criteria for Pending Facilities

To satisfy the new audit criteria, data center operators must submit documentation detailing their operational footprint. Required disclosures include information the centers previously claimed was "proprietary information".

Energy Strategy

Clarification on whether the facility relies on independent, on-site power generation or intends to draw directly from the public grid, along with projected annual and peak electricity needs.

Water Consumption & Technology

Comprehensive estimates of annual water usage, supply sources, water recycling capabilities, and specific cooling infrastructure, such as air-cooled or closed-loop systems.

Community Protections

Information regarding noise suppression protocols, light abatement, setback distances, traffic planning, and local emergency coordination.

Corporate Transparency

Full disclosure regarding facility ownership structures and controlling financial interests.

Grid Capacity Pressures Drive Regulatory Pause

The regulatory intervention arrives as energy requests from technology infrastructure reach unprecedented levels across Texas. ERCOT is currently reviewing approximately 474 gigawatts in total interconnection requests, an amount exceeding five times the state’s all-time record peak electricity demand. Notably, data center projects account for roughly 90 percent of these new capacity inquiries.

It Could Not Come at a Worse Time

State leadership warned that unmonitored load growth of this magnitude poses severe risks to power grid resilience. Electrical reliability remains a major issue in Texas, where widespread system failures during a 2021 winter storm resulted in hundreds of fatalities.
